With the increasing attention to maintaining and improving environmental quality and protecting human health, organizations of all sizes are increasingly paying attention to the possible impact of their activities, products or services on the environment, and the global environmental protection movement is surging. The subsequent ISO14000 series of environmental management standards have attracted great attention from industry, commerce, government departments, non-profit groups and other organizations around the world. China is in the stage of rapidly promoting industrialization and urbanization. Facing the situation of environmental pollution and resource shortage behind the rapid economic development and prosperity, how to coordinate the relationship between economic development and environment is a severe challenge. ISO14000 series of environmental management standards provide a new tool for China's environmental protection work with a new concept

however, in the process of implementing ISO14001 environmental management system standard, there is a wrong idea: confuse environmental protection laws and regulations with ISO14001 environmental management system standard, do not understand the relationship between them, and think that China has a series of environmental protection laws and regulations, it is enough to implement them carefully, or as long as the pollutant emission meets the standard, environmental management is not needed, Or you can apply for certification without violating environmental protection laws and regulations, and so on. The existence of these wrong ideas greatly restricts the full implementation of ISO14001 environmental management system standard in China and affects the realization of sustainable development strategy

the relationship between them and the role of environmental protection laws and regulations in the establishment and implementation of environmental management system are described in four sections below

1 China's environmental protection laws and regulations system China regards environmental protection as a basic national policy, and has formulated and promulgated a series of environmental protection laws and regulations to ensure the implementation of this basic national policy. The structure of China's environmental protection laws and regulations system can be explained from both vertical and horizontal perspectives. 1.1 vertical structure of environmental protection laws and regulations system

according to the differences in the main levels and effectiveness of formulating laws and regulations, the environmental protection laws and regulations system mainly includes the following seven levels:

① Constitution: formulated by the National People's Congress. It is the basis of China's environmental legal system and has the highest legal effect in the whole legal system

② environmental protection law is not only Zhengye International: it is formulated by the National People's Congress and its Standing Committee. It has the legal effect second only to the constitution

⑥ in 2018, our company independently developed several new models of local environmental administrative regulations: formulated by the people's governments of provinces, autonomous regions, and municipalities directly under the central government and other local people's governments that have the power to formulate local administrative regulations according to law in accordance with laws, administrative regulations, local environmental regulations, and environmental administrative regulations

⑦ other environmental normative documents: in addition to the above-mentioned levels, the normative documents on the rational development, utilization, protection and improvement of the environment and resources formulated by the people's Congress at or above the county level and its Standing Committee and the people's Government in accordance with the constitution, laws and regulations

1.2 horizontal structure of environmental protection laws and regulations system

according to the content and function of laws and regulations, the environmental protection laws and regulations system mainly includes the following two parts:

① comprehensive environmental law: environmental protection law is the basic environmental law and comprehensive environmental law

② separate special environmental regulations. Including: a environmental pollution prevention and control, such as water pollution prevention and control law, air pollution prevention and control law, noise pollution prevention and control law, etc; B natural environmental elements and natural resources, such as forest law, grass source law, coal law, mineral resources law, etc; C. cultural environment protection, such as regulations on the protection of scenic spots and natural reserves; D laws and regulations for environmental management, supervision, monitoring and ensuring the implementation of laws, such as the administrative measures for environmental protection of construction projects, the administrative regulations for environmental monitoring, the Interim Measures for reporting environmental pollution and destruction accidents, the time limit treatment system, the total amount control system of discharged pollutants, etc; E environmental organization regulations; F relevant laws and regulations on environmental disputes; G others, environmental planning, plans, international environmental conventions concluded or acceded to by China, etc

2 ISO14001 environmental management system standard ISO14001 environmental management system - Specification and use guide are the core of ISO14000 series of environmental management standards, and also the only standard in this series of standards that can be used as the basis for the third-party audit and certification of environmental management system. It puts forward requirements for the organization to establish an environmental management system for certification, registration and self declaration, and other standards are its supplement, interpretation and application

implement ISO14001 standard, that is, integrate environmental management into the overall management of the organization, establish an environmental management system according to the PDCA cycle management mode, consciously incorporate environmental protection into the enterprise objectives by using management means such as policy, planning, implementation, inspection and review, and strengthen self-management and improve the enterprise's environmental management ability through internal audit and management review. 3 Relationship between environmental protection laws and regulations and ISO14001 environmental management system standard 3.1 ISO14001 environmental management system standard is a set of management standards for scientific management of the environment

ISO14001 environmental management system standard is to summarize a series of system elements according to the internal relations and operation laws of various management activities, and consider discrete and disordered activities in a unified and orderly whole, making the system more convenient for operation and evaluation.
